Position paper - Digital fairness – fitness check on EU consumer law

The European Commission announced in the New Consumer Agenda that it will analyse whether additional action is needed to ensure an equal level of fairness online and offline. The fitness check will look at different pieces of EU consumer protection legislation to determine whether they ensure a high level of protection in the digital environment.

Consumers are protected by extensive rights that mandate pre-contractual information obligations for traders. At this stage, a revision of the Unfair Commercial Practices Directive regarding the digital angle does not seem timely nor needed.
