As the trilogue meetings on Representative Actions have begun we have continued outreach with the European Parliament and Council of the European Union. Although meetings have been suspended for the time being due to COVID-19, we have built on existing messaging and developed our views on domestic vs. cross-border cases. We would therefore like to emphasise that the definition of Domestic Representative Actions in the Council’s General Approach is that the autonomy of Member States to regulate their domestic representative actions will be de facto diminished under the current definition.
